Proposal to rate as Incompetent

    The VA informed us in 2 separate letters that my 89 yo MIL was awarded A&A pension, and that they are proposing to rate her as Incompetent due to Dementia diagnosis. We would like my husband, her son to be appointed as fiduciary, but don't know what to do next, as letter only mentioned the option of a hearing which we don't want.What do we do?

    Thank you.The article says the applicant and fiduciary must meet with a VA field agent, in the event that both live outside the US , as is our case how is this handled? Would both have to travel to US for this meeting? Could it be done at US embassy in country of residence?

    That is a very good question, Maven. I would say you have to call the VA to see what they advise on that situation. I have never encountered that particular situation myself or known of another person on the forums who has, but the VA might at least be able to tell you how that would be be handled. 1-800-827-1000
