    My mother-in-law's application was filed in October of 2011. Payments began around May 2012. I was under the impression retroactive payment would go back to the date application was filed. We've been told it goes back to approval date. Can you confirm?

    You are correct--once the benefit is approved, it is applied retroactively to the date of application.

    What dates are stated in your award letter? The first section of our letter is entitled "You award amount and payment start date." It outlines the total VA benefit, the amount withheld, the amount paid, the effective date and the reason for the change (original award).

    In our case, we applied in February 2011, and the effective date of the award was March 1, 2011 (the effective date is the 1st day of the amount following the date of the application.)

    Many folks submit form VA Form 21-4138 Statement in Support of Claim to initiate the process. The claimant then has 1 year to submit all required documentation for the application. In this case, the form 21-4138 is the date of the application for benefit purposes.

    You may still be entitled to retroactive payments that will not be released until the competency issue (if applicable) is determined.
