Just received Award Letter for A & A benefits.  Also received Elgibility Verification Report & Medical Expense Report.  Accompanying letter is not clear.  Do I fill out the EVR & MER for the three month period ending 2009 ?  One place says I have 30 days another says within one year Huh  Within that letter they also state that I can claim backward for prior years???   Not clear.   I think I could see the three month quarter after they received the package, but their other comments did not make sense.Huh?  Time is short please let me know.

New Legislative Rule - if you can prove that medically and financially you should have gotten the award up to 12 months before you filed, the VA will give you that extra award!!  How great is that?  The letters started changing a few months ago.  So read carefully - that's what they are offering you - show medical and financial need up to 12 months back on the EVR and medical expense report - you will need a physician's evalaution that states that "as of month you choose" that the applicant needed XYZ help.  As to the 30 day/1 year - was incompentency proposed?  If yes, 30 days to waive due process.
1 year to argue anything with award and to go after the extra months we just discussed.

Hi Fit2009, Im lost, Let me see if I  understand you....If I needed and would have qualified for A&A in January,2009 both medically and finacially but didnt file an application for A&A  until April, 2009 (which has been approved back to date of application in April) I could now ask the VA for the money spent from January until April before i filed?HuhHuh??

THANKS CHERI.  Letter not clear at all. We are not claiming incompetency, we are not seeking help further back than 4th quarter of 2009.  Although, we could probably easily receive the back Award sum.  We are up to "my eyeballs" in daily living and trying to take care of everybody without shuffling more papers and meeting more deadlines.

Question:  Is there an Annual evaluation questionaire that the VA sends?  As I said previously we received the award for Oct, Nov. Dec of 09 that was submitted in August and they officially received Sept 09.  I thought perhaps they wanted all receipts & medical info for the last quarter of this year??

fit2009 your talking about liberalizing law right?

that only applies in certain situations. for example, if the vet is presumptive for pension. if the vet is rated for PT, then the lib law doesnt apply.

im wondering what office your out of? and if your a VSR or a VSO?  Smiley

Hi Kayellen,
They think he might have been eligible earlier - not kidding!  If medically he was in need and his assets weren't substantially higher back then, you have a very good chance of getting at least something for something - fill out the EVR and see what happens.  Get a statement from his doctor and fill out the Medical Expense Report for the period - even if he wasn't incurring the same level of medical expenses, he might get a partial award for the period.
For example, I have a woman whose dad was living with her, he has ALZ.  After moving into the ALF and applying for the benefit she received the same letter as you did.  She tallied up the expenses from when he was living with her and while they aren't high enough to justify the $1,644 per month, it looks like they will get about $800 per month for those prior 12 months.

As Pologal said, not everyone is entitled to this.

Pologal, was does PT mean?  Which probably answers your question, I'm not a VSO or VSR, I am a retired CPA who spent my life reading federal regulations (SEC) and enjoyed that so much - which most people don't - that I wanted to put that unique talent to use helping the elderly.
