I am an elder law attorney and I have a client living in an independent living facility, and I am wondering what needs to be done, i.e. a doctor's note about help with ADLs, or what circumstances will allow for the rent paid to the facility to be counted as a medical expense?

I am also seeking help in what I have to do for my Father to receive the A&A benefit since we have moved him to an independent living/assisted living senior facility.  I have been told that since he is in a "independent" living facility he will probably not be able to receive this benefit.  They have the 24/7 medical staff on site and I understand that that is one of the things that quailifies him.  Since he cannot cook for himself, his meals are also provided.  I was also told that some of the tenants that live in his facility do get this benefit and that is why I am not giving up.  If I can pay someone to administer his medications then that would be a another plus.  I don't want to get discouraged but if I can just know the exact documents I need then that would really help.  Appreciate any help if anyone can help us.  Good luck to you Justin.
