My mother received a letter from the VA saying her DIC benefits have been denied, although she is applying for Aid and Attendance only.  The paralegal handling her claim says not to worry, the VA will deny the DIC claim and then look to see if she qualifies for Aid and Attendance.  Am I right to continue to be concerned about this? What am I missing?

Thanks

The VA basically processed for the wrong thing, and if you are working with a paralegal, they will get it straightened out and let the VA know it is for Pension.  May add a little time on to the process.

The application for Pension with A&A is also an application for DIC, so when they make a decision on the pension award, if she did not provide any info on DIC, the DIC will automatically be denied.  You should not have received a letter only denying DIC unless she did not provide income information.  Look on the bottom of page one or the top of page 2 for information regarding pension.  If you give me some more details, I could probably give more guidance.
