I am helping my grandmother, who is 88 and a surviving spouse of a WWII vet, apply for the surviving spouse aid and attendance benefit.  She recently moved to an assisted living facility.  We live in Indiana.  I am getting some conflicting information and I am hoping someone can help clear up a few questions.

1.  I was told that the asset limit was $50,000.  She is slightly above that level, but below the $80,000 listed on this site.  What is the correct asset level?

2.  I was given a form for the assisted living facility to fill out documenting her monthly charges.  The form I see on this website is for a nursing home.  Which form should I send in?

3.  Can I include Medicare Part D monthly premiums on the application in Section IX?

I also found out the forms I was given to fill out are not the most up to date.  I have accessed the application through this site and have them completed for the most part.  (Thanks!)  I have some additional questions:


4.  I was reviewing the directions for the 21-534 and at the end of the instructions, it refers to a checklist.  I could not link to a checklist.  Where can I find the checklist?

5.  My grandfather died in late 2008.  We paid the funeral costs out of pocket.  I also set up a funeral trust for my grandmother last year.  Should I include those costs on the application ?  Section IX of the application mentions these costs.

6.  I am my grandmother's POA and I understand that they will not recognize this.  When I send in the application, should I submit form 21-0845 (Authorization to Disclose to a Third Party) or Form 21-22a (Appointment of individual as claimant's representative)?

I'd appreciate any input on these questions.  Thanks!

#2 You can use the form the ALF gave you, which should be a Statement of Occupancy

#4 The checklist is no longer available, but you can look on the site for a list of necessary documents

#5 No on the funeral costs

#6 Do not send 21-22a.  Only include the 21-0845.  If the VA finds incompetency, then you can do the 21-22a along with your request to be appointed as Fiduciary.

Hello All,
I'm so glad I found this site.  I have a question about what exactly the physician should write when filling out the medical statement form.  In other words, how disabled does one have to be?  My Grandmother needs 24 hour care, but can dress and feed herself, she just can not be alone for her own safety.  Also, I don't know how to post on this site, only reply to other people's posts.  Could someone please give me instructions on how to post a question? Tammy,

Welcome and we are glad that you found us. 

Her doctor simply needs to state what her physical condition is with any limitations and why she needs someone with her 24 hours.

As far as posting goes, you would just start a new topic and ask your question.  If you still run into problems let us know.
