My mom, a nursing home patient, [ her husband, a WW11 vet.] was awarded death pension with aid and attendance, dating back to Aug. 1 2008. [ Retro. amt.  14000.00] + 1056.00 per mo.] She was supposed to receive the retro. amount within 15 days, but being found unable to manage her own affairs, a fiduciary had to be appointed and I was, effective Aug . 19 2009. My mom passed away Sept. 15 2009 without any funds being issued. We had been supplementing her income for the last year to pay the nursing home . Any recourse?

First please let me extend my condolences for the loss of your mom.  This is obviously a difficult time for you, and this seems an unfair additional burden for you to bear. I hope that this information will be of some assistance to you.

To answer your question, yes you do have a recourse. Please see this link from our FAQ's regarding a loved one passing prior to funds being released.
