I have been reading so many interesting things on this site...it is really terrific!  I wish I found this site months ago.

Only problem is I am more afraid now that I made a mistake when I let that attorney file my Dad's papers.  (for nothing you get nothing).  I went to her the first time Nov 1, 08, she didn't file the papers till sometime in Feb.

When I was talking about my concerns over how the papers were filed my Dad told me he once applied for medicaid, but they said he earned to much, even though in the divorce agreement he gave my mother his SS check.  They said they didn't have to abide by the divorce agreement.  He gave her all his money because he gambled their money away, including his IRA's.

Anyway, I am in constant fear that she is going to stop paying the bills for him.  If he doesn't get the most he can get from this assistance (which is what the lawyer told us he would probably get), I don't know what my mother is going to do.  My gut feeling is that the lawyer has to put down all his medical expenses as though he pays them, why put down the assisted living, and not the secondary medical insurance, and the medicare part D?  It just doesn't make sense to me.  Can an adjustment be made on the forms now?  Is it to late?  Do you know if I can file them or does this attorney have to file them? 

I am so sorry for all these questions, I can not sleep, just  way to worried about everything.

(just so you know when my Dad was in the hospital in January he was septic, the doctors wanted him to go on dialysis, I said NO.  They told me without it he was not going to survive.  My Dad was not "with  it" for many days, and then he slowly came out of it to the shock of his doctors.  When he went into Rehab, he wasn't able to get out of bed without the help of 2 people.  His first step was after being in rehab for several days.  At the family meeting I was told that he would probably have to remain in the nursing home, this is when the papers were being filed, this is probably why I didn't look them over, I went to the rehab almost every day to urge my Dad to work harder, and to get better).
