I am considering using form 21-601 but I have a question.  I helped support my mother before and after she submitted her application for AA to help her pay assisted living and then nursing home expenses.  The application was still pending, but I believe she would have been approved, however she passed away 11 months after submitting the application.  Since she actually paid her expenses, (with my help) am I entitled to be reimbursed for what I gave her?

The challenge you will face is that the award was never granted, so there are not accrued amounts for you to file against.  That does not mean that you cannot file stating that they delayed the application process and that in that time it was necessary for you to pay her expenses, and the claim would have been approved.  You would have to be able to prove by check or cc receipts that you personally made payments to the facilities or caregivers.  If you simply put money in her account for her to pay, I don't believe you will be able to make a case.
 
In situations such as this, it is not so straight forward, and should you decide to file, keep in mind it will be a bit of a battle.  You only have one year after death to make this application, so time is critical for you at this point.

Thank you for your response..what a racquet the VA has going.  I was trying to help my mom retain some independence by giving her the money so SHE could pay the nursing home...(even though I was managing her bills)  so now I am out of luck. So for all others out there on this path..make sure you pay whatever expenses directly if you need to help financially, and do not reimburse your loved one.

I'm sorry.  They make this so complex from start to finish, and all anyone is trying to do is take care of a loved one.
