Form 21-22a

Hello again,

Thank you again for your help with my previous questions concerning forms 21-0845 & 21-4138.

Today I came accross form 21-22a to be appointed as a claimant's (my mother) representative.
Is this a viable avenue to pursue given my mom's pronounced dementia?
I've had recorded DPOA since 2006.

No.  The purpose of this form has been replaced by the 21-0845.  This will come into play later when you file to be appointed as her Fiduciary.

For now you just do the 21-0845 so the VA can discuss the application and staus with you.

form 21-0845 is AUTHORIZATION TO DISCLOSE PERSONAL INFORMATION TO A THIRD PARTY

form 21-22a is   APPOINTMENT OF VETERANS SERVICE ORGANIZATION AS CLAIMANT'S REPRESENTATIVE

DO NOT do the 21-22a. 

You simply reply to the letter they sent.

Once you receive notification from the VA that they find it necessary for a fiduciary to be appointed you should submit Form 21-4138 and include the following statement:

Please be advised that (parent's name) and I have no issue with the VA finding of incompetence and wish to proceed with the appointment of a fiduciary. We wish to appoint myself (her/his insert your relationship to the veteran) as fiduciary. I understand that I must be interviewed prior to that appointment and would appreciate such an interview be scheduled as soon as possible.

My Mom can't see at all (she's legally blind), and I need to fill out all the forms on her behalf.  I'm a lawyer (although I do real estate law - not this stuff) - can I/should I use the Form 21-22a to be able to take over the processing for her instead of the 21-0845?  Many thanks for your advice

At this time, I would just do the 21-0845 so that you have the ability to speak with the VA regarding her application.

In completing the paperwork for her, she still needs to sign everything.
