My adopted Dad, Ed is now in an assisted living facility, has been there for almost a year now.  We are considering bringing him back here to our home as he is pretty lonely and a bit afraid he is going to die and be all by himself.  They have been really good to him, but the fact is that many times when he walks down the hall to the nurses desk, there is no one there as they cover three floors with like two people and later on just one.

He has had nightmares he is caught in a fire etc. etc.  Anyway right now my husband is here to help out with his care so we could do this.

What my question is he was awarded the aid and attendance rating, the full 1644 per month amount.  So what would we do, I mean what form etc to notify VA, that he will be leaving the assisted living facility and coming back to our home to be cared for here by my husband.

When you report this, use a VA Form 21-4138 explaining the date of the move.  Also, if you intend to have an in-home care provider for him, arrange this in advance so that VA can exchange the assisted living expense for the in-home care expense.  This will prevent any interruption of benefits depending on the size of the expense.

Oh thanks VSR for your reply here, sorry I have not been on here in a couple days.  Well what we plan to do is my husband and I will be his caregivers here?  Then we sign a contract with him, and charge him the same as the assisted living facility.  Will that work?

We realize of course we will claim this on our income tax as well.

I hope you got my email while I was in Nashville for my daughter's wedding in response to your question, but I see that VSR has covered your question.

Your plan will work fine, and yes you will need to claim it as income.

Yes Debbie you guys on this forum are great.  You have helped me tremendously with all of this.  Ed is very excited to come home.  But this year, almost he has been in assisted living was very good for him and us, he was able to get over being deserted by his grandkids, he has one living son out of six, who is in bad health, worse than his 91 year old dad, who cannot do very much it seems. 

But anyway we had asked him to give this place time and see how it went and then we would discuss him living here with my husband and me.  So he did, and we got all the paperwork with VA taken care of as well as making some great new friends there.  We will take him back for visits as well they have respite care available there if we ever need it.

Again your forum here has been invaluable.  Thanks again and again
