On the evr...block 4A...if mother is in an assisted living facility and not a nursing home, do I check yes or no. Last year I checked no, skipped to Block 5 (as per instructions) and funds were suspended for four months because I did not complete Blocks 4B, 4C, and 4D (which refer to nursing home)...any way to avoid this problem this year... Huh

not sure why funds were suspended but it could be because of the paperwork BEFORE.

I always find this question (poster's) interesting.  Why would someone not answer it correctly?  There really is no grey area.  a Nursing Home is only a Nursing Home. If she is NOT in one then you can't put yes.
If you put yes, then you automaticly trigger a $90 monthly award.  And there is not a place to put 'yes,but'. The form says to answer every box, so you in b, c & d put N/A. (not applicable).

It could just be that you answered it correctly AND the VA got it wrong.

That really is the sad part about the VA.  We have to try to 'figure uot' what they are thinkinjg!!!  If they would just follow the instructions and the rules, 90% of all of this would go away.  I have been involved with Government Benefit programs for more than 10 yrs.  I have helped more than 1000 families. While the various Medicaid/Medi-Cal programs have their little glitches.........NOTHING compares to the complete madness of the VA process,  NOTHING.  I have gone into remote counties that are doing something incorrect, and within a month or two, the state will send down corrections and proper clarificatioin and the problem is fixed. permanently.  If fact, the county (in MODOC County) thanked me.  Try getting a thank you out of the VA........

I'm in an Assisted Living Facility and on my form 21-526, I answered yes  to the nursing home question and no Medicaid assistance.My app was approved within 2 months from receiving it.

On my last year's EVR I checked yes to no.4 and in the space between the question and the answer boxes I wrote
"Assisted Living Facility" and checked no Medicaid assistance. My EVR was approved without question.

I don't know the definitive answer, but it worked for me...

well we could follow the logic one step farther....

Go ahead and put yes for nursing home........then cross out nursing home and put Assisted Living......or RCFE.......or Board & Care.......... Undecided


Then, go ahead and check the Medicad box yes.  And cross uot Medicaid and put Medicare.... Shocked......Gosh, everybody get those confused also. 
   

Truely, the best course of action is do what is the correct answer moving forward.  Wink

 VA Pension or Compensation with a rating is NOTcountable income in any state in the United States for Merdicaid eligiblity. That is a fact.

When counting Medical expenses for A&A rated pension, the VA considers an Assisted Living Facility as a type nursing home.
It's not a Skilled Care nursing home, but the VA accepts it as a nursing home.

Answer yes to 4A and notate that it's an assisted living facility and 4b,c,and d are self explanatory.
Medicaid does not enter the picture because I realize that if she's receiving a full A&A rated pension, she
cannot be on Medicaid, so check no for Medicaid.
