a caregiver contract?
My mom has a caregiver that we pay per an invoice that the caregiver submits, but there is no contract per se.
Also, my sister takes mom to doctor and that i understand could be an amount payable to my sister but does there need to be a contract?

MJ,

You can just draw up a very simple statement of services and amounts to be paid.  You will need to pay by check (never in cash) and keep copies of all cancelled checks.  You would do the same for your sister and determine a rate to be paid for both.

You should check with a local elder law attorney as well.  Although the VA's requirements for paying caregivers are not terribly stringent, Medicaid's requirements are.  If your parent needs Medicaid in the future and you paid any caregiver without following Medicaid's requirements, those payments would be looked at as an uncompensated transfer and therefore penalized.  It's cheaper and easier to do it right the first time because that's not a problem you can easily fix after the fact.
